Terms of Service

By accessing or using CortexForge Farm (the "Service") at farm.chemosi.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legal agreement between you and CortexForge ("we", "us", "our").

CortexForge Farm is an AI-powered land and agriculture planning tool for smallholder farmers. It helps you map fields, plan crops, track expenses, monitor weather, manage tasks, and receive AI-generated recommendations based on the farm data you enter.

To use the Service you must create an account using a valid email address (via magic link) or by signing in with Google. You agree to:

• Provide accurate, current, and complete information
• Keep your account credentials confidential
• Notify us promptly at hi@chemosi.com if you suspect any unauthorised use of your account
• Be responsible for all activity that occurs under your account

You must be at least 18 years old to create an account.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to other accounts or to our systems
• Reverse-engineer, decompile, or scrape the Service
• Interfere with or disrupt the Service, including by overloading, flooding, or spamming
• Submit false or misleading farm or location data
• Use the Service to harass, abuse, or harm another person, or to impersonate any person or entity
• Resell or redistribute the Service without our written consent

The Service uses AI models (including Anthropic's Claude) to generate recommendations about crops, soil, weather, and finances based on the data you provide. These recommendations are advisory only. AI models can produce incorrect, incomplete, or outdated information. They are not a substitute for professional agricultural, veterinary, financial, or legal advice.

You are solely responsible for decisions you make based on these recommendations. CortexForge is not liable for outcomes resulting from those decisions, including crop loss, livestock loss, financial loss, or any other damages.

You retain all rights to the farm data and other content you enter into the Service ("Your Content"). You grant CortexForge a limited, non-exclusive, royalty-free licence to host, store, process, transmit, and display Your Content solely to operate the Service for you and to perform the activities described in our Privacy Policy.

We do not use Your Content to train AI models. We do not sell Your Content to third parties.

The Service, including all software, designs, branding, text, and content other than Your Content, is owned by CortexForge and protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works of the Service without our prior written permission.

The Service is currently provided free of charge. We reserve the right to introduce paid plans in the future. If we do, we will give you reasonable advance notice via email and will not charge you without your explicit consent.

You may delete your account at any time from the Settings page. Deleting your account terminates these Terms with respect to you, subject to provisions that by their nature survive termination (including disclaimers, limitations of liability, and governing law).

We may suspend or terminate your access to the Service if you breach these Terms, if your use poses a security or legal risk to us or others, or if we discontinue the Service. We will give you reasonable notice unless an immediate action is required to comply with the law or to protect the Service or its users.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. We do not warrant that the Service will be uninterrupted, error-free, secure against unauthorised access, or that recommendations or other outputs will be accurate.

TO THE FULLEST EXTENT PERMITTED BY LAW, CortexForge will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, crops, livestock, or business, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) USD 100.

You agree to indemnify and hold harmless CortexForge, its officers, employees, and agents from any claim, demand, or damage, including reasonable legal fees, arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the Republic of Kenya, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts of Nairobi, Kenya.

We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated via email to active users at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
